ANGELES CITY – A contractor who endorsed the failed congressional bid of Councilor Ares Yabut has filed before the Ombudsman a complaint against the city treasurer in connection with his alleged failure to collect P10 million as payment for a completed slope protection work in Barangay Balibago here.
In documents obtained by Punto on Wednesday, Bernardo “Bernie” Cruz of BP Cruz Builders and Trading on May 18 has charged City Treasurer Juliet Quinsaat for violating Republic Act 3019, also known as the Anti-Graft and Corrupt and Practices Act.
He also accused Quinsaat of asking him to give the former a share or percentage of the due collection amounting to P9,725,692.41.
“That this City Treasurer is pressuring me to come up with the payment in her favor a certain share, percentage, commission and / or benefit notwithstanding the availability of the fund for the project, and due to my refusal to accede from her demand, the same refused and release payment in my favor,” said Cruz of L and S Subdivision here in the affidavit.
“That the aforementioned projects were already completely accomplished / finished, hence, the corresponding disbursement officers already approved the release of payment / collection for the said project, a xerox copy of the Disbursement Voucher is hereto attached and marked as Annex “C” to form the same as an integral part hereof,” said Cruz, referring to the certificate of project completion issued by City Engineer Donato Dizon and Engineer III Paterno Tayag for the said slope protection work.
“That Ms. Quinsaat, notwithstanding several demands being made / sent to her, the same still failed and refused to release payment in my favor, a xerox copy of demand letter is hereto attached and marked as Annex “D” to form the same as an integral part hereof,” he added.
“That Ms. Quinsaat, being the City Treasurer of Angeles, with a level of Grade 26, Step 2, failed to consider the fact that her office is a public office which entrusted to her public trust, hence, she should discharge her duties with utmost responsibility, integrity, honesty and loyalty and should uphold public interest over personal interest as she neglected and refused, after due demand or request to release payment in my favor, and without sufficient justification, she failed to act within a reasonable time on my request, notwithstanding the fact that all the necessary papers / documents and the approval for the payment of the project, in addition to the availability of the fund for the project as the City of Angeles was then declared in a state of calamity, however, Ms. Quinsaat failed and refused to release my collection / payment for the project until I would agree to give her share, percentage, commission and or benefit,” said Cruz.
Quinsaat could not be reached for his comments.
