ANGELES CITY – The Nepomuceno family has expressed their desire for an amicable settlement with owners of an international golf course in Barangay Cutcut here, stressing they aim for a “win-win solution” to end the land row which erupted last January 16.

In a press conference on February 11, Councilor Atty. Bryan Nepomuceno, legal counsel of the Neplum Incorporated (NI), said they are “definitely open” for negotiations with Ruperto “Perto” Cruz and his family, owners of the Royal Garden Golf and Country Club (RGGCC).

Neplum closed the RGGCC’s access road from Cutcut for the second time on February 8 after Regional Trial Court (RTC) Branch 56 Judge Irin Zenaida Buan denied the application of the Cruz family for a writ of preliminary mandatory injunction on February 8.

At the wee hours of January 16, Neplum, owned by the Nepomucenos, built two concrete walls on their 1,000 square-meter property blocking the road to the 18-hole golf course run by Cruz and his Korean partners.

Atty. Nepomuceno said “price is not of importance” when asked how much will they sell the property to Cruz.

“What is important is that there will be an agreement that will be acceptable to our family. Selling the portion of the property for profit is not the primordial consideration in the negotiations,” said Nepomuceno in the press conference at Oasis Hotel attended by his cousins and other Neplum officials – Gerard Nepomuceno and his brother Christian, Dennis Nepomuceno Antonio and his brother Dale.

For his part, Dale said they are “in business and for business” and they will exhaust all means to reach an amicable settlement beneficial to both parties. His brother Dennis said “it’s okey” if the Cruz will make an offer or not to buy the property.

Christian and Gerard echoed the sentiments of Atty. Nepomuceno, saying they are open to negotiations for a win-win solution.

Atty. Nepomuceno stressed to Punto that “hindi mahirap kausap ang mga Nepomuceno”.

The Nepomucenos urged the media and the Cruz family to “double check” their information before releasing it publicly.

They denied that there was hostage-taking during the 40-standoff last month when Neplum closed the property for two days but was ordered open after the issuance of a writ of demolition.

In report by Station 5 commander Chief Insp. Ronaldo Lorenzo, he said “as earlier reported and personally checked by the team of police officers of this station (5), precisely refuting the report that no Koreans guests and employees including the residents were being harassed neither detained inside.” Lorenzo’s report was provided in a press kit from Atty. Nepomuceno.

The councilor-lawyer said the Koreans and other RGGCC employees could have passed at the back portion of the golf course in Pulong Maba, Porac town at the height of the stand-off last month.

It was reported by Punto on January 20 that some Koreans, including a 76-year-old woman and children, were trapped at the golf course and prevented from leaving the premises but later released after the intervention of the Commission on Human Rights (CHR).

Atty. Nepomuceno said “politicians in the family should be spared.” He added that the topic should be focused on the disputed property

The Nepomucenos said “the case was still being heard in court then”. ‘This is the reason is why it was only last Friday that we called for a press conference.”

Asked how come Cruz was able to construct a cemented road at their property, Atty. Nepomuceno said “we don’t know how that road was constructed.”
