Consultations on Ease of Doing Business Act to be held in San Fernando

The Department of Trade and Industry through its Competitiveness Bureau (DTI-CB) will hold Consultation Meetings on the Implementing Rules and Regulations of RA 11032 (Ease of Doing Business and Efficient Government Services Delivery Act of 2018) to be held on 13 September 2018 at Heroes’ Hall, City of San Fernando, Pampanga. The consultations will have two separate sessions, with the morning session (8:00-11:30 AM) to be conducted for the public sector, while the afternoon session (1:00-4:30 PM) is intended for the private sector. The consultations will be led by DTI-CB Assistant Secretary Mary Jean Pacheco and by officials of the DTI and other government agencies and local government units.

On 28 May 2018, President Rodrigo Duterte signed into law RA 11032 – “An Act Promoting Ease of Doing Business and Efficient Delivery of Government Services by amending Republic act No. 9485, otherwise known as the Anti-Red Tape Act of 2007. The law aims to promote integrity, accountability, proper management of public affairs and public property, as well as to establish effective practices aimed at efficient turnaround of the delivery of government services and the prevention of graft and corruption in government. The law mandates government agencies to adopt sound and good regulatory management practices. It also aims to improve the ranking of the Philippines in terms of competitiveness.

The Law created the Anti-Red Tape Authority, under the Office of the President, tasked to plan, implement and oversee national policy on anti-red tape and ease of doing business. The ARTA is empowered to receive complaints, initiate investigations, and assists in filing of cases related to violations defined under the law. Likewise, the Anti-Red Tape Authority shall recommend policies, processes and systems to promote regulatory reform among LGUs and NGAs.

Pursuant to Section 30 of RA 11032, the Anti-Red Tape Authority with CSC and DTI, and in coordination with DICT, DOF, DILG, NEDA, PSA, CDA, SEC, Office of the Ombudsman, HLURB, and the Union of Local Authorities of the Philippines (ULAP), shall promulgate the necessary rules and regulations within ninety (90) working days from the effectivity of the Act.

The DTI-CB has been designated as the temporary secretariat of the Anti-Red Tape Authority under the law. It is organizing a series of consultative sessions on the Implementing Rules and Regulations.

Because of the law’s significance, a broad-based consultative process has been designed to ensure that there will be responsive, fair and well-defined implementing rules and regulations. The public consultative meetings for the EODB/EDGSA IRR are designed to ensure effective implementation of policies and programs and strengthen active participation from stakeholders at the national and local levels.
