MABALACAT, Pampanga – Candidates for village chiefs in one of the most populated barangays here will present their respective position papers on Friday at the Commission on Elections (Comelec) in connection with disqualification case filed against Barangay Captain Javier Taruc.
This was learned from Dapdap Councilor Armando Rivera who filed a disqualification case against Taruc before the Comelec provincial office on October 8.
“Taruc has already served as village chief of Barangay Dapdap for three consecutive terms violating the law,” he said.
Rivera and Taruc attended a hearing at the office of Comelec officer Atty. Temmie Lambino on Tuesday and were told about the proceedings of the case.
Punto called Taruc on his cellular number 0916-5212704 but didn’t return calls and text messages to this reporter. Rivera, who topped the councilor’s race for two consecutive terms, will challenge Taruc.
A certification issued by the Department of Interior and Local Government (DILG) office here revealed that Taruc was elected to the same position for three consecutive terms during the synchronized barangay and SK elections in 1997, 2002 and 2007.
In his petition for the disqualification of Taruc, Rivera noted that “On October 5, 2010, Taruc has filed his certificate of candidacy for Punong Barangay of Dapdap, Mabalacat.”
Rivera said that Taruc “committed deliberate misrepresentation of a material fact and perjury” by certifying that he did not serve for three consecutive terms.
“The foregoing Material Misrepresentation is evident by the fact that respondent is the incumbent Punong Barangay of Dapdap, Mabalacat, Pampanga, for the present term 2007-2010, who has been elected and serve thereto for three consecutive terms already, first on May 12, 1997; second on July 15, 2002 and thirdly on October 29, 2007,” said the petition obtained recently.
Rivera urged the Comelec to remove the name of Taruc on the official list of candidates in the upcoming barangay polls on October 25.
“On the basis of the foregoing material misrepresentation, the certificate of candidacy of respondent shall be deemed or ordered cancelled and denied due course,” said Rivera.
Rivera who personally served the petition against Taruc at the Dapdap Barangay Hall said that the latter refused to receive the copy of the petition on October 7, 2010. Taruc’s Barangay Secretary Dan Manalang received the copy in behalf of Taruc.
Rivera went to the residence of Taruc but the village chief was not in their house.
Meanwhile, some residents of Barangay Dapdap have called on Taruc to withdraw his candidacy because he has already served for three consecutive terms.
“Hindo napo siya dapat maghain ng kanyang kandidatura dahil bawal ito sa batas,” said one resident.
“He is no longer entitled to run because he has already served the three-term limit. This is a clear misrepresentation and clear violation of the law,” said Rivera.
“Ito po ay maliwanag na paglilinlang sa aming mga kabaryo,” said Rivera.
Dapdap is home to the Madapdap Resettlement Center (MRC) where victims of Mt. Pinatubo reside after the devastation.
Latest records showed that Dapdap is one of the top three most-populated villages among the 27 barangays.
