ANGELES CITY- Pres. Aquino was lumped with Janet Lim Napoles and several others as respondents accused
of plunder, among other charges, filed yesterday before the Office of the Ombudsman by the Kilusang Magbubukid ng Pilipinas (KMP).
The complaint-affidavit was with an “urgent motion to issue order for preventive suspension” of the President and the other respondents. The KMP, represented by Rafael Mariano, Wilfredo Marbella, and Nestor Villanueva, said in the complaint that Pres. Aquino “is being charged in this case as he approved the release of Malampaya funds for projects or purposes not in accord with the law.”
“His acts of approving the release of the funds to projects or purposes not related to those which the law, specifically Presidential Decree 910, so provides lead to the plunder of the funds by bogus non-government organizations (NGO) in conspiracy with the officials of the Department of Budget and Management (DBM) and the Department of Agrarian Reform (DAR,” the complaint said.
The respondents also included Budget Sec. Florencio Abad, Agrarian Reform Sec. Virgilo de los Reyes, Agrarian Reform Undersecretary Narciso Nieto, Agrarian Reform Undersecretary Jerry Pacturan, and Budget Undersecretary Mario Relampagos. Apart from Napoles who is already detained in Fort Santo Domingo for charges filed against her by the Aquino government, the other respondents were officers of the alleged fake NGO’s, including Teresita Reyes, Ashley Baul, Benhur Luy, Simplicio Gumafelex, John Raymund de Asis, John Lim, Nemesio Pablo Jr., and “John and Jane Does.”
The charges included alleged violations of the Anti-Plunder Law, Government Procurement Reform Act, Anti-Graft and Corrupt Practices Act, Code of Conduct and Ethical Standards for Government Officials and Employees, malversation of public funds, and grave and serious misconduct.
The other accused government officials were accused of being “principals by indispensable cooperation” in the
release of Malampaya funds “not related to energy development.” The private respondents allegedly “connived
and conspired with the government officials in the commission of the offenses hereto charged.”
