CDC issues CDO against $2-M sewerage project

    CLARK FREEPORT – A cease and desist order (CDO) was issued on Monday against the proponents of a $2-million sewerage handling and sanitary disposal project here by the Clark Development Corp. (CDC).

    CDC General Counsel and Vice President for Legal Affairs Perlita M. Sagmit signed the CDO against L.C.

    Soliman Septic Tank Inc. and TesuPhils Inc. which partnered under a memorandum of agreement (MOA) for the construction of the project on a 1.5-hectare lot in Barangay Calumpang, Mabalacat City which is covered by the Clark special economic zone.

    The CDC said “based on records, the project was neither referred to nor approved” by CDC or the National Commission on Indigenous Peoples (NCIP) or the Aeta Indigenous Cultural Community’s (ICC) Ancestral Domain in violation of the law, particularly the provisions of RA 7227 as amended or the Bases Conversion and Development Authority (BCDA) and RA 8371 or the Indigenous Peoples’ Rights Act (IPRA Law) and the Joint Management Agreement (JMA) between the CDC, NCIP and the Aeta ICC.

    The CDC said “per monitoring and inspection of our Estate Preservation and Recovery Department personnel,” the proponents “already started the project without CDC’s approval, necessary endorsement from the NCIP, EPIC from the Aeta ICC and Environmental Compliance Certificate (ECC) from the Department of Environment and Natural Resources (DENR).”

    On June 16, TesuPhils Inc. represented by its president Lydia Soliman and L.C. Soliman Septic Tank Inc. represented by its chairman Si Young Chon signed a MOA for the project with Senator Lito Lapid, Central Luzon Police Regional Office 3 OIC Chief Supt. Ronald Santos, and Malabanias, Angeles City Barangay Captain Rey Gueco standing as witnesses. There were no representatives from the CDC, NCIP and the tribal communities present during the signing.

    The project is expected to be completed in August this year said Alfredo Soliman, director of L.C. Soliman.
